Ploom Device Upgrade Terms

The following Terms and Conditions of the Ploom Device Upgrade (“Ploom Device Upgrade Terms”) govern the legal framework of the Ploom device upgrade, under which users may exchange their Ploom X Advanced heated tobacco device for the new generation of Ploom heated tobacco devices, the Ploom AURA, through a one-to-one device replacement initiative.

 

1. Device Upgrade Offer and Eligibility

JTI offers users the opportunity to upgrade their Ploom X Advanced heated tobacco device (“Ploom X Advanced”) for the new generation of Ploom heated tobacco devices, the Ploom AURA (“Ploom AURA”) at no additional cost to the user (“Device Upgrade Offer”). Eligible for benefiting from the Device Upgrade Offer are users of JTI’s website (https://www.ploom.ch/en) (“Website”) who are resident in Switzerland and have registered a Ploom X Advanced to their Website account.

 

2. Orders

Before placing the device upgrade order, users must accept these Ploom Device Upgrade Terms. When users place a device upgrade order, they will receive an email listing the order details and confirming that JTI has accepted the order. From this point on, the exchange agreement is deemed to have been concluded and the order can no longer be changed or cancelled. Ploom AURA cannot be returned or exchanged and Ploom X Advanced cannot be reclaimed.

 

3. Maximum device upgrade quantities

Users can upgrade one Ploom X Advanced for one Ploom AURA device. If multiple Ploom X Advanced are registered with a user, the user must select the device subject to the trade-in during the order process.

 

4. Product availability

JTI endeavours to ensure optimum availability of the Ploom AURA. However, if the devices are no longer available, the user will be informed of the resulting delay in delivery or partial or complete cancellation of the device upgrade order.

 

5. Device upgrade process

An order for the device upgrade on the Website may be placed by users who meet the eligibility conditions outlined in Section 1 of these Ploom Device Upgrade Terms. Following order confirmation by JTI, the Ploom AURA will be shipped to the user’s address as indicated in the order. Shipment will only be made within Switzerland. The indicated delivery times are non-binding.

The user must return the Ploom X Advanced selected for trade-in using the prepaid return envelope provided with the shipment. The return must be completed within two (2) weeks of the user’s receipt of the Ploom AURA. If the return is not completed within this period, JTI reserves the right to withdraw from the exchange contract, reclaim the Ploom AURA, and seek compensation for any resulting damages.

The Device Upgrade Offer is a device exchange program that comes at no additional cost to the user.

 

6. Resale

The resale of products purchased or traded-in on https://www.ploom.ch/en/ is strictly prohibited.

7. Applicability of General Terms and Conditions of Sale

In addition to these Ploom Device Upgrade Terms, and unless otherwise provided herein, the General Terms and Conditions of Sale (https://www.ploom.ch/en/terms-and-conditions-of-sale) apply. For the purposes of the General Terms and Conditions of Sale, the Ploom AURA shall be deemed the purchased Product.

 

8. Applicable law and place of jurisdiction

These Ploom Device Upgrade Terms are governed by substantive Swiss law; the sole place of jurisdiction is Lucerne, Switzerland.

 

9. Term and Duration

This Device Upgrade Offer is valid from 1 September 2025 until 31 December 2025. Notwithstanding the foregoing, JTI reserves the right to discontinue the Device Upgrade Offer at any time without prior notice.

 

10. Data Protection

In the course of the device upgrade process, records in the user account on the Website relating to the previously owned Ploom X Advanced will be erased. JTI’s processing and retention of personal data is outlined in the Privacy Policy published on the Website: https://www.ploom.ch/en/privacy-policy.
