Refer a Friend Terms and Conditions

1. General information

This referral programme (the ‘Programme’) is part of the ‘Ploom Club’ and is organised by JT International AG Dagmersellen (‘JTI’ or ‘we’), Baselstrasse 65, 6252 Dagmersellen, Switzerland.

Participation in the Programme is possible as long as the Programme is active on the platform. If the Programme is discontinued, JTI will inform participants at least 30 days prior to discontinuation through one of its communication channels.

2. Terminology

‘Referring Person’ means the registered ploom.ch account holder who recommends Ploom to a friend.

‘Friend’ means a friend of the Referring Person who is 18 years of age or older, is already a smoker, vaper or consumer of another nicotine product, has their primary residence in Switzerland and receives a referral message and referral code from the Referring Person; does not yet have a registered Ploom account and has therefore not yet participated in the Programme.

‘Referral Reward’ means a credit of 1’500 Ploom Club Points to the Referring Person's Ploom account or such other reward as may be announced by us from time to time.

‘Friends’ Reward’ means a credit of CHF 20 applied immediately at checkout to the Friends first qualifying Device Bundle or Device purchase on ploom.ch or such other reward as may be announced by us from time to time. The Friends' Reward is limited to one reward per friend. Qualifying purchase excludes cancelled/returned orders.

‘Bonus Milestone’ means a credit of additional Ploom Club Points for the Referring Person, when they reach certain referral milestones.

3. Eligibility to participate

All smokers, vapers and nicotine users who are at least 18 years old at the time of participation and have their main place of residence in Switzerland, hold an active Ploom account on ploom.ch and have agreed to the current Terms of Use and Privacy Policy available on ploom.ch are eligible to participate in the Programme.

4. Refer-a-friend procedure and associated benefits

The Referring Person logs in to their Ploom account to access the My Referrals Dashboard or the Refer a Friend Page to view their referral code.

The Referring Person shares the referral message and the referral code with their Friends via email or any messaging channels made available for this purpose. The Referring Person must observe the following:

• They must ensure that they only share the recommendation message and the recommendation code with Friends as defined herein.
• They may not recommend themselves or the same friend more than once.
• They may only share the referral message and the referral code with Friends via email or any messaging channels made available for this purpose.
• They may not share the referral message and the referral code in open social media, groups, broadcast lists or large sharing platforms.

The Referred Friend must create a Ploom account.

The Referred friend must add their referral code in the dedicated field either:

• during the Ploom account creation process;
• during the checkout process for the first purchase on ploom.ch.
• At any time before the first purchase of a device or a device bundle in the Account Dashboard

Once the Referred Friend has created their Ploom account, added their referral code, and purchased their first qualifying Device Bundle or Device purchase on ploom.ch the Referring Person will receive the Referral Reward.

The Referring Person may refer multiple Friends and, subject to these Terms and Conditions, will receive a Referral Reward for each of the Friends referred. In addition, the Referring Person is also eligible for Milestone Bonuses for reaching certain referral milestones. Each milestone reached corresponds to an additional amount of Ploom Club Points awarded once when hitting the Milestone according to the following overview:

• 1. Milestone: 3 Friends’ referrals = 500 Ploom Club Points
• 2. Milestone: 6 Friends’ referrals = 1000 Ploom Club Points
• 3. Milestone: 9 Friends’ referrals = 1500 Ploom Club Points

After the 9-referral milestone has been reached, no further Milestone Bonuses will be awarded.

The Referral Reward will continue to be credited for up to 9 successful referrals per month meeting the conditions in 4.5, even after the all-time referral milestone has been reached.

Each Referral Reward expires after twelve months (‘Validity Period’). The Validity Period begins on the day on which the Friend purchased their first Device Bundle or Device purchase on ploom.ch.

Each Referral Reward or Friends' Reward can only be redeemed once on ploom.ch. Referral Rewards or Friends' Rewards are non-refundable, non-transferable and cannot be redeemed in any other way.

The Friend is not permitted to share the referral message and referral code received with third parties.

5. Notification of receipt of the reward

The Referring Person can view their Referral Rewards balance in the My Referrals Dashboard or the Refer a Friend Page. The Friends' Reward will be directly applied at checkout to the Friends first qualifying Device Bundle or Device purchase on ploom.ch and no additional communication will be sent.

6. Exclusion from participation

If JTI reasonably suspects or determines that a participant (including a Friend or a Referring Person) (a) has provided false, misleading or incomplete information in connection with the Programme, (b) has created multiple user accounts, or (c) has otherwise abused, manipulated or attempted to manipulate the Programme or its reward mechanism (including by technical means), JTI may, at its sole discretion, exclude such participant from the Programme. In such case, any Referral Rewards, Friends' Rewards and/or Bonus Milestones obtained or claimed as a result of such conduct (or in connection with the excluded participation) shall be forfeited and shall be deemed null and void.

In addition, JTI may delete or suspend the participant’s Ploom account on the relevant website and, where applicable and permitted by law, any other user accounts held by such participant on other JTI websites, and may deny such participant access in the future.

JTI may refuse or block (a) the delivery of referral messages and/or referral codes to a Referring Person and/or (b) the use of a referral code by a Friend, if there are reasonable grounds to believe that the Referring Person or Friend is misusing the Programme or is otherwise in breach of these Terms and Conditions or any applicable terms on ploom.ch.

7. Responsibility and liability

Referral Rewards, Friends' Rewards and any other benefits under the Programme are not redeemable for cash and no cash alternative will be provided.

WhatsApp (WhatsApp LLC), Telegram (Telegram Messenger FZ-LLC) and any other third-party messaging service that may be used to transmit a referral message and/or referral code are third-party services. The Programme is not affiliated with, sponsored, endorsed or administered by any such third party, and no such third party assumes any responsibility for the Programme.

8. Data protection

The Privacy Policy on ploom.ch (as amended from time to time) applies to the Programme and is incorporated into these Terms and Conditions by reference. JTI processes personal data provided by, or collected in connection with, Programme participants for the purposes of administering the Programme and providing the Referral Rewards, Friends' Rewards, and Milestone Bonuses in each case in accordance with applicable data protection laws and the Privacy Policy.

9. Changes

JTI reserves the right to amend, suspend or terminate the Programme and/or these Terms and Conditions at any time.

If JTI discontinues the Programme, JTI will inform participants at least 30 days prior to discontinuation through one of its communication channels. For other material changes to the Programme, JTI will provide Referring Persons with reasonable notice where required by law or where JTI otherwise considers it appropriate.

The version of the Terms and Conditions published on ploom.ch at the time a Referral Reward or Friends' Reward is credited shall apply to such Referral Reward or Friends' Reward. JTI may, at its sole discretion, continue the Programme in a modified form.

10. Applicable law and place of jurisdiction

These conditions of participation are subject to Swiss law. The exclusive place of jurisdiction is Lucerne, Switzerland.
